Please join us for a seminar at Albany Law School on New York State’s Article 10 – The Siting Statute for Electric Generating Facilities over 25 MW. As part of the Government Law Center's work with the New York State Energy Research and Development Authority (NYSERDA) under a four-year incentive to create sustainable networks that support early-stage renewable and clean energy companies, we are pleased to announce the next seminar in the Renewable Energy Entrepreneurial Seminar Series (REESS). “The New Article 10: Siting Process for Electric Generating Facilities” will be offered on April 2, 2012 at Albany Law School from 12:00 to 1:30 PM in the 3rd Floor Boardroom of the 2000 Building. This event is free and open to the public, and lunch will be provided.
This educational seminar will provide an overview of the new law governing the siting of electric generating facilities in New York. Article 10 will control the siting of electric generating facilities with a capacity of 25 MW or more, and provides for review of applications to construct, operate and/or modify electric generating facilities. Under Article 10, any projects with capacity of 25 MW or more will be required to obtain a certificate of environmental compatibility and public need. In addition, the new application process will require a description of the proposed facility, demonstrate compliance with various health and safety regulations, and provide a comprehensive review of the demographic and economic description of the community within which the facility will be located.
The seminar is intended to educate attendees about the new Article 10 siting process and the process for obtaining certification. Specifically, the seminar will discuss how the process applies to smaller wind energy projects that fall within the 25 MW threshold. The panelists will be posed with a series of hypothetical questions to provide a practical analysis of the law. The panelists will include: Terresa Bakner, Esq., Partner, Whiteman Osterman & Hanna; Hon. Kimberly Harriman, Esq., Administrative Law Judge, Department of Public Service; William Little, Esq., Office of General Counsel, Department of Environmental Conservation; Elizabeth Grisaru, Esq., Of Counsel, Whiteman Osterman & Hanna.
For more information or to RSVP, please call D’vora Koelling at 518.445.2329 or email her at dkoel@albanylaw.edu by March 30, 2012. We look forward to seeing you on April 2nd.
